Equal
Status Case Turned Down on Techniciality
David
Green has been in the News quite a bit as the person who's test case was
taken under the Equal Status Bill. David is 21 and works in IBM. He paid
£4,017 for his first insurance and after a years safe driving renewed
the policy for £4,070. He has since got a full licence but still
pays £3,500. David has an accident free driving record in his Honda
Civic.
Unfortunately
we have to report that David Green's case before the Office of the Director
of Equality Investigations (ODEI) has been turned down on a technicality.
David took out the insurance policy before the Equal Status Bill came
into effect and even though we argued the discrimination has been ongoing,
the ODEI didn't think his case would stand up in the event of a court
appeal as the original contract date is what counts according to them.
MIJAG is now looking for a similar case to take where the Insurance Policy
was only taken out recently.
A
positive result for us in the Equal Status case would have been a major
boost but thankfully we were not counting on this for a successful outcome
to our Campaign. The next big event will be the publishing of the eagerly
awaited MIAB Report.
